    You both have rights to this child,but  why did she give you the child?Does she have drug/alcohol problems,or was she having trouble coping?Do you feel your baby will be looked after responsibly by his mom,if you have any doubts about your childs well being,he cannot be placed back into her care,if you think that she is responsible to care for the child,then hand him back to his mom (the baby needs love from both parents).Make sure you have as much contact as possible with your child and check that he is getting loved and cared for.If for any reason you suspect neglect,you must report her to the childrens welfare authorities,and maybe you can apply for full custody.

    You should file for sole custody of the child, if that is what you want, and seek child support from baby mama (I hate that expression).   You should not give up the child under any circumstance.  She has, from the little you've told us, apparently abandoned the baby.  
    Get thee to a family law attorney or legal aid service before you finish reading this.  There is more at stake than you know.

    Had you filed "ABANDONMENT" when she did this, you wouldn't be going through the hassle now, so yes contact an attorney, ASAP!

    bigdaddy i am so happy you found this site.  maybe you can get some true wisdom and grow to be a person of wisdom instead of a foolish person, like so many people walking around this planet. bigdaddy, the mom has a right to see her loving child.  people get emotional about these kind of issues.  bigdaddy please get a 3rd party, like a counselor.  Somebody that will help you guys and walk through what is good for you both and the little truly precious one.  if out of control emotions rule, you child will be confused and hurt.  get help for your kid so your child will have sense in this world and not be one of the 'crazies' out there.  get a counselor, if you cannot afford, get a minister.  get a wise person.  get any person that can help guide you thur this.  eventually one day, you may be guiding someone thur the same situation, but you have to get the wisdom first, by going thur it and coming out on the other side, in a positve manner.  that means where the end result is beneficial for the kid, you, and the mom.  good luck and stay in touch with the folks here on this site, they are truly beautiful, wise and the best!
