Here, the keys have to be in the ignition.  That's it.   If you are standing beside a car acting like a drunken fool and upsetting others it is called, "Drunken Disorderly". .... Were the keys in the ignition?... and was he acting like a drunken fool?

Sorry but, it all comes down to what the cops say............

If he had driven the car there or the keys are  in the car, and he was the only one at the car .......Yes.  --But I do not know the whole situation  from that time  to be able to say for sure............He could still be arrested for under the influence.

Intent is the question. If standing outside the vehicle which is not running and the keys are in your pocket, there is no way you will be convicted. If this is the case, get your "Good" buddies to testify to those facts in court.

If you crashed the car to the extent where it can no longer run, as a result of your being drunk, what do you think?

If he went before a judge and told him he was " innocedent." I would've given him a suspended sentence for originality. Bet it never happened before with a " vechial".
