    if a cop hand cuffs you and says your under arrest but doesn't read you the rights can you get out of the charge

    I think you have a valid case but you have one major issue, it's the cops word against your word and unless you have witnesses who will back up your story; the cop will win.

    My little brother was arrested and when talking with the lawyer he mentioned that he wasn't read his rights and the lawyer told him that that only happens in the movies..........

    Was his attorney a Public Defender, if so he would say that because they work for the State.

    He doesn't have to read you your rights unless he tries to get information from you. He needs to inform you of your right to have an attorney before he questions you.

    Cops do nothing except bully people. They are revenue thugs to collect money from you .We had a State police officer get a award for being a great cop one month later he was caught on camera "DOING" a woman on the hood of his police car on film in broad daylight .I suppose we should be grateful he choose a woman instead of ????? The only thing they are good for is to show up after the bad guys are gone and write things down. They kill people here all the time and nothing is done .You should try living in Albuquerque the "Over Dose capitol of America" .

    Not all cops there's just bad apples in the process, I wasn't a bad/bullying cop as long as the subject wasn't being stupid, like trying to resist arrest, etc., but yes their are some that gives the good, honest ones a bad name...

    Legally under the law once you have been detained (Unable to come and go as desired), you must be read your rights, so yes if you were detained, cuffed and arrested the officer(s) were required to advise of your rights, so if you can prove the charge, yes you could win your freedom but like CB said without witnesses it's your word against theirs unless it was video/voice recorded.

    My (step father) is a retired police sergent. He was a good cop who treated people kindly. He wasn't a bully cop just out there trying to see how many tickets he could write. Of course, he served back in the day that when a drunk driver was pulled over he could just stick the passenger in his car and give the person a ride home. Things have changed so much since way back then.

    That only works on "Law & Order".Don't count on it to get you off scott free.

    What about your new law introduced after sept. 11, giulty by suspicion, hold you as long as they like, so much for the land of the free, a bit like South America, here one minute gone the second.

    Cops generally "Marandize you". When taking a statement from you, you have to sign it in dozens of places to cover the cops ass. You should be more specific on the charges.
