    When is a father not the legal not the custodian of his child?

    When is a father not the legal custodian of his native american child of 6 yr and his wife is not to be found and we have legal papers where the courts have tried to find her.  We don't know where to turn.  Everyone says he does not have custody.

    If his name is on the birth certificate, he has legal custody. If it is not on the birth certificate, he will have to prove parentage then go to court and file for custody of the child. He may have to file for custody on the premises the child has been abandoned by her mother.

    This Child has native american blood my son married a cheyenne arapaho indian. She has been gone for 4 years we have a court document where they oouldn't find her. Where does this leave us with the American Indian Child Welfare Act? Oh his name is on the BC
