My brother watches his daughter who is 25 years old with special needs. He gets a check for such for home help care from the state. It used to be not taxable and now they say it's taxable and did not notify him of such.

They did not have him do a withholding form and now they say that he has to file taxes. Will he be able to draw unemployment too since he has to claim such wages?

He should contact them about the withholding and fill out a form to correct it. If he does it immediately, he shouldn't have to pay taxes on it.

If this is money to help support his daughter, he should ask at the unemployment office if this will affect his unemployment check amount.
