As tires wear they will effect the your speedometer reading. The taller the tire (new) the less it has to turn in order to achieve a given mile per hour. Worn tires have to turn more often to achieve that same mile per hour. unfortunately this is NOT in your favor. A general rule police will go by is a 10% fudge factor. You either pissed him off or he had a bad night. The judge may throw it out, they don't want to clutter the docket with something so petty. Good luck.
