can a parent take kids over border w/o other parent's consent
I'm a US citizen living in Canada for the past 10+ years, married to a Canadian citizen. We are separated 3 months and I'm pursuing divorce proceedings. He was arrested on a domestic and is out on bail. I want to take our 4 children to visit their grandparents in Virginia this summer and he won't give me parental consent. Can I still go across the border if I get a court order?

A court order would nullify his non-consent. He might have registered the kids with the US State Department, if it is possible to do this, and/or the Canadian equivalent, to prevent this sort of thing. Upon entering the US, you can be denied entry and so could your kids, and get tied up in the bureaucracy.
