Harvey was killed during a domestic dispute at his ex-wife's Spring Valley Home. He was shot by Vincent Salvato, his ex-wife Paula Bates' fiance, in what they maintained was self-defense. Although no charges were filed against Salvato, the case became a rallying point for a group of parents protesting a court referee's decisions in divorce cases. The protesters maintained that unfair rulings by the domestic referee created the acrimony that led to the slaying.
Harvey is buried in the same plot as William A. Bates.
