I do not believe it is a law. However, usually per diem workers earn a higher hourly salary that "full time" workers. Because of that Companies usually do not extend benefits to the per diem workers. Keep in mind companies can make their own salary scales- and over the past few years salaries have dipped. Also kieep in mind the "right to work" States have fewer laws protecting employees.
