Would it not depend on the laws of your state? Rather than ask a bunch of hacks (no offense to anyone), but it would be in your best interest to contact an attorney or legal aid service.
What does your son want? As much as it may gall you (and it certainly would me) to allow my son to see that guy, to withhold the connection might bite you hard one day. IF you have to allow visitation, insist on supervised. INSIST.
Remember, too, that your son loves you. Please do not talk about his dad in any kind of negative way. That is difficult, too, but it will benefit you. My sister never spoke ill of her son's father, but he ragged her down every chance he got. Their son just turned 30 and has been in therapy with his dad for a few years, trying to get past the hurt. One day Nephew told "dad" that Mom had never bad-mouthed him. "Dad" was in total shock, and his attitude did a quick 180. Nephew and Mom have always had a solid relationship.

The Law is different as i am in the UK if he has no custody what so ever or as a legal custody then he has no rights whats so ever but I dont know the law in your Country if you are in the States if he has been paying for the up keep of this child then this is a different ball game you need to speak to some one who is legal or child agencys

Has he been paying child support? If not The law may say he abandoned him and that his rights can be terminated. I would get myself an attorney who deals with child custody issues on a regular basis. You may want to start procedings to terminate his rights before the father starts something. Get a hold of Legal Aide in you state or see if there is an attorney who will take your case Pro Bono,
that means for free and it is "suggested" by the Bar Association that all attornies do some Pro Bono work each year.
