    can someone cash in a trust fund without a proper signature from inheritense holder

    It's quite possible if the beneficiary of the check is incapacitated.  However, I would work with the payee's attorney to determine the best way to protect the interest of the intended recipient.  An example would be to open a separate account in order that these checks can be deposited into.
