there is no lease in place. would a month to month be good. we don't think it would be fair to take in any new tenants and then be forced to toss them out. we would just charge them what they have been paying. does that sound fair? we would put this in a mini-contract?

There is nothing wrong with a month-to-month, but you should still have a contract showing the rules and expectations. If there is no contract, it automatically defaults to month-to-month. A security deposit is a must if you want to protect your property. As a landlord you need to be aware of special state laws which you must abide by. One law which many new landlords are not aware of regulates the time and notification procedures a landlord must follow concerning the security deposit.
