    Under what circumstances may a tenant withhold partial payment of his rent ?

    I state in my lease that I will pay for trash collection. A tenant noticed he was being billed by the city for trash removal, added the total for the year he has been living in my building, and deducted it (nearly $400 ) from his current rent check. I say it is illegal for him to do that. Am I correct or does the tenant have such privilege?

    You state you will pay for trash removal. He got charged for trash removal. He did what your lease states and charged you for the removal. He can do that.
