          "Disparate" means "distinctive", or "different,", so "disparate treatment" means "to be singled out, or discriminated against".

     


    An intent to discriminate a person or group based on a prohibitive characteristic such as age, race or gender.


    "Disparate treatment" exists, for example, when an employer treats some individuals differently and less favorable than others AND the different treatment occurs because of the individual's "protected status" (e.g. race, sex, disability, etc.).
