My name is William Fairbanks and for the last 20 years, I live on Leipzig, Germany. One of my friends sent my your letter about VRAB's decisions and that's the reason I am writing to you.
I retired from the Canadian Army as a Master Warrant Officer and shortly after my releae I filed a claim about severe chronical headaches and periodic depressions and claimed it on chemical exposure of TOF (airsprayed) in Camp Wainwright in 1962. The claim was rejected by DVA but then went all the appeal stages till its final rejection by the Veterans Review Board in May 2001.
I could see DVA's problems in accepting my different appeals and so I added particular incidences that happened throughout my military career, such as my exposure to DIAMOX during the 1971 high altitude trials at Mont Logan, my work as test director in DREV and my exposure to asbestos in Lahr, Germany, but none of them changed that final review. All of my evidences included references and in some case also pictures.
I'd like to point out that I was a military paratrooper for 7 years and suffered severe casualties for which I already get paid by DVA. One of those is my casualty payment for Agent Orange which we tested 1967 in Camp Gagetown, NB.
However my severe headaches have become more severe and I'd like to reappeal that decision which apparently I cannot since not long ago, I was told by DVA Ottawa that my 2001 decision was final.
I don't recall that your comment about a 30 day appeal for a Judicial Review was contained in my letter from DVA since otherwise I would have taken it.
