Unfornately they can in the UK - they would take the word of the nurse, in case she left him - so very unjust and can even get the practice manager involved. It is all so business orientated here and of course everybody is covering their back. They say here there is a thing called patients autonomy but once in their hands the patient nowadays looses their autonomy (I have been told by so many professionals) Your life is in their hands and their hands are in their pockets. So very unjust and lacking in humanity..

Interesting question - if the mistake was not one of the risks explained when the consent form was signed then yes. You would need an expert witness to decide if one of the risks could result in this kind of mistake. There are risks and definately mistakes - the differentiation is important. Even if you do not have a copy of the risks explained to you there will be standard documentation of these risks.
