if someone smokes in a non-smoking hotel and starts a fire will they be arrested?
the last 2 days my son and i had 2 stay in a motel due to weather in our area it was non-smoking this guy smokes and catches a towel on fire in his room nobody was hurt but does that mean he goes to jail? i live in MS

I'm not sure they would be arrested unless they put up a fight but I am pretty sure they would be issued a citation and fined. That is if the police are called in.. I would think that the hotel management would ask them to extinguish it first or be asked to leave, or at least ask to be switched to a smoking room if they have this.

Regardless of the smoking issue, a fire is a fire. The charges can only be based on a criminal offense such as arson or negligence. Accidents may not qualify in this category. That being said, the smoking ban rules and laws vary by state. You need to check state law for applicable statues in this area.
