    Can a merchant take my credit card if the transaction failed and said to pick up card? If so, is it legal?

    Usually the merchant takes the card to process the transaction at the time of the purchase. If the transaction doesn't go through they should hand the card back to you and the purchase is void. You don't get the item you wanted to purchase, they give you back your card. There is no reason for them to keep your card - unless they believe you stole it and even then they should call the police to investigate - not keep your card.
