Hmmm, essential elements of a valid custom. Well, a custom is a social practice carried on by tradition. So:
To start with: It must be carried on by the entire tribe or family. The family must believe in it without question. It is handed down generation to generation. There is a reason the custom started even though its real history may be marred by exaggerations and forgetfulness.
