    the advice about the custody of a child if the mother have passed away you where not married with the mother of the child ,which procedure to be followed?

    For the most part in most all  the states in the US, you have to petition the court for legal guardianship, then go through the adoption process. Immediate family has first request to take the child. Your best best is to consult with an attorney that handles family matters. 


    Unless, you are saying you are the father of the child? Is your name on the birth certificate? If so, that makes things easier. You just take custody of the child. Otherwise you will have to prove you are the father through DNA testing.

    i'm quite sure about the child is mine she is 11 years old ,and her mother passed away long ago now the child is staying with her granny , so the child is telling me that she no longer want to stay with her granny , she want to stay with me ,to me i have realised that the child does not get parental care at he granny ,she don't get that love of parent's . the granny don't give the child the parental love ,she is greedy for the maintainance money which i pay at the court , the child have told me that she don't want to go and stay with her granny again it seems the child is afraid to tell me the whole story of how her granny treat her , because during the festive season 2013 we have spent her holiday together the child was happy and free ,it seems they treat her bad and treathen her if she can tell me about the way they treat her ,my fear is that this can cause a trauma to the child and disturb her at school,which procedure can i follow ?. i did go to talk to the child granny to let me stay with the child ,the granny of the child said to me we must arrange the day to held a meeting about the child she had to call one of her family to discuss this matter .

    Petition the court for sole custody of the child. You will need a lawyer. See if the child can be given a Guardian Ad Litem to make sure she is safe in the home. One can be provider for her though child services. You have to prove the child is being neglected. If you have any child services there, call them and have them investigate how the child is being cared for. Good luck and remember, I do not know where you live so I am answering according to USA laws.

    First, pay for a DNA test to determine that the chile is your’s and then talk with a lawyer……..
