Under the Schengen agreement there are no border controls between Spain and France nor many other European countries ( Not including the UK) so the question is meaningless.

Absent a finding of smuggling by Customs, it has to be assumed he's smuggling nothing. How is this a brain teaser? What do you think would happen if you went into a store, was accused of shoplifting, arrested, but the store couldn't find anything that you "stole", and neither could anyone else?
