    how can the da tell you a charge and a punishment and then when you say you want to fight it the DA can up the charge to something that instead of probation will give you jail time if you loose in court

    There will be a minimum and a maximum sentence the judge can impose depending on the charge, if you plead guilty to said charge the judge may take this into consideration and impose a less severe sentence, if you fight the charge and lose, the judge will probably impose a more severe sentence given the evidence against you.
