Generally, that lies within the States Motor Vehicle Code, which regulates the "privilege of driving on the public roads," and thus not a criminal offence. It is only enforable on the public roads as well.
Which means it is NOT enforable on PRIVATE propery, like the WalMart lot or a Golf Course parking lot, were one need not be lincenced to drive!
