No. The trust fund if for the child's loss of support from his father. None of it is for the step mother. My ex brother in law thought the same thing, that he was owed something. My niece and nephews got a million dollar settlement for their mother's wrongful death. He "invested" their money into houses and lost all the money when the housing market crashed. He thought he would make a big profit on the homes with him keeping the profit. The kid's ended up with nothing. The step mother has no business expecting to be able to touch any of that money. She needs to keep her hands off it, just like my ex brother in law should have! She should have filed a suit herself for loss of her husband.
I'm not a lawyer this is just my opinion.
