      YES, they are responsible for the removal of the tree and the repairing of the fence whether they do it or you charge them for your labor and cost.

        What you mustn't do is chop up the tree for firewood & refuse to let them have it back :-)

          Contact your homeowners insurance they'll be able to get their insurance info. or you can sue small claims court'
