    Can the Spouse of a deceased property owner complete an Affidavit of Heirship on his or her own behalf or does it need to be done by a third party? The surviving spouse is not listed on the deed

    The property was bought early in the marriage by the deceased only. The two remained married until the death of the owner... The spouse is the sole survivor but their name is not entered on the property deed. There is no will.

    Wait, you've changed your story. What's up with that? Now my answer is, was the house left to you in a will? If no, this needs to go through probate since your name is not on the deed.
