If you mean settled out of court, typically different deals are offered between the two lawyers until each accepts the deal from the other. Or if the case is a civil one (like a small claims suit) that does not have to have a judge decide it and is without a doubt provable against one party, the lawyers will settle via a deal given by the plaintive's lawyer.
