A physical threat to the life of a person is being proceeded in a Town Court under NY State Penal Law 240.26 subsections 1. & 3. Harassment in the 2nd degree.Has the accued comitted a CRIME.
The section constitutes ' violation '. But the threat to the life of a person is an extremely serious matter, as the threat if allowed to be treated lightly, might encourage the killing threatened
