Criminal lawyers tend to use numbers just for the simplicity. Mostly, these numbers correspond to the section of the Penal Code that we refer to. A 1538, actually a 1538.5, refers to the Penal Code section governing the motion to suppress evidence. So a motion to suppress evidence hearing is simply a 1538. It’s easier to say I have a 1538 rather than I have a motion to suppress hearing, which is a mouthful.
