      Your mother may not have the knowledge but she would have been required to sign the loan documents.  You could go after the relative for deception, i.e., asking your mother to consent without really explaining it to her, then pocketing the loan proceeds.  This is not an easy case to prove, nonetheless.


      I am sure this kind of situation happens more frequently than you think.  Good luck to your mom.
