    can an apartment community discriminate because a person is a felon

    Yes, at least so here in Texas.  The apt association will not allow felons to rent here……….

    Fact is that they probably cannot, but should be able to.  Many felons do straighten out, however, so there are both arguments. 

    In the USA, private businesses can say no to people they feel pose a risk to their business and clientele and they are within their legal rights to do so. Felons or ex felons are not covered under the non discrimination law  because they did choose to break the law. Time served does not erase that. Only businesses that accept subsidies from the state or federal government can not deny a rental to a felon or ex felon.

    Sometimes they will run a background check on you before they will allow you to move in.

    They run background checks on you at most places here in Michigan, and if you have a felony on record, they won't allow you to move in.
