    Trust Fund Question....

    My trust fund states that I'm to have my electronic needs met but it's up to the trustee's discretion (my sister). Wouldn't you think that statement would refer to cable television and a smart phone?  (She says I don't need a smart phone 'cause my flip phone works and I have my Mac)  Thoughts?

    Your sisters "discretion" is unbalanced, if there is a clause in the trust that states that you be happy she is going against your Fathers wishes,it's not as if you are even asking for very much, does your families attorney have any say in these matters?


    As Ben said, it's time to talk to someone, other than your b***h of a sister.

    It works for me. Yes, i have an atty but she has say so on wether the trust pays for it. She won't allow someone else telling me something she feels she can answer..... I feel like I'm a lost case.......

    Her being an attorney herself makes it a touchy situation. You'd think, though, she would understand the obvious challenge of being objective about herself!!!

     I would tell her right up front that you are concerned about the management of the trust and you want to talk to the attorney of your choice.

    I AM NOT trying to "win"anything. I just want what is graciously mine. No begging, no argument, no guilt trip. This doesn't need to be a contest of wills. I'm not second class......

    You might try ACLU  I think they might advise you for free. It wouldn't hurt to contact them. They may help you find a way to be able to get some one to look into this for you! Sounds like you are in a cage! Sorry!

    ACLU probably won't even answer the phone for an individual. They prefer big groups and the opportunity to grab the front page.

    When I sought their assistance several years ago, I was told ACLU was interested in representing a group rather than an individual. Perhaps the association has evolved.

    Is there a conflict of interest here?  Sounds to me like she should not be involved, but another lawyer to avoid the opportunity for a conflict.  If she were not a lawyer, I guess it would not matter anyway.  Just a thought.  Good luck.  In my family, the only thing that I inherit is bills!  Maybe that is not so bad, as your situation.  Regards...

    Problem is, the trust specifically states that James cannot benefit from it thus, I cannot get cable because James might watch it......

    This sounds strange, Seems like the compentency of the trustee is questionable. Not mentally right to make decisions for you. But why does she make those decisions. Its like your taking away from her resources for you. Money in family relationships tends to separate family members. Good luck to you, not an easy situation.

    I have a legal dept,that will advise me on complex matters ,and if they feel that it is of a speclist nature,they will pass me on those whoes domain they feel that is suitable,Good luck,Juilie,

    I read it to mean that if you became unable to take care of yourself, someone else would have the say-so about the ventilator and other electronic apparatus to ensure you keep living and breathing and taking in nutrition, such as the tube feeding electronic box.


    And I would think that if you were in a vegetative state , you wouldn't know the difference between cable TV and regular TV. And you wouldn't need any kind of a cell phone.

    That's what P.O.A.'s are for. I have good insurance. The trust states that I'm to be happy. How is anticipating my death going to help that?
